Mesothelioma is a rare form of cancer that is caused by inhaling asbestos fibers. Asbestos is a natural mineral rock which is mined then the fibers from it are woven and added to material. It was discovered for it’s excellent fire-retardant and thermal insulation properties and was widely used in many industries, i.e. to insulate water pipes, and used as a fire retardant in wall cavities and ceilings etc. People who had mined and worked with asbestos over a long period were more supceptible to developing mesothelioma – which can take 10-40 years to develop.

In 1985 it was finally banned from when more and more cases of asbestos -related diseases became more prevelant. People with asbestos-related disease were advised to sue their employers for compensation – hence the reason why they had to appiont a lawyer and attend court.

Approximately – 3.000 people a year still die from mesothelioma and these figures are likely to continue up until 2020.

Asbestos still lurks in thousands of old public buildings today and is still a health hazard.

For example, if you work for a construction company and there are works involving taking off roofs with asbestos on it. The company should give you proper work gear that would protect you from asbestos exposure. Another example is when you live in an older apartment building and the roof or walls have asbestos. This should have been taken out in the 70s when asbestos was banned.

My father-in-law was recently diagnosed with mesothelioma. He is a disabled vet on a limited income. The life expectancy is only 4-18 months. He and my mother-in-law have filed a lawsuit against the asbestos manufacturer. The concern is that they have very little money and without compensation we are afraid that my mother-in-law will lose their house when he passes. Does anyone have experience with this?

Additional Details

Thanks for answering. The lawyer says that because he has the disease that we have a good case. Mesothelioma is caused almost exclusively by asbestos exposure.

We have filed the suit against the manufacturer because we believe that he was exposed while working in the boiler room while in the army and suing the army just isn’t an option.

The lawyer we have retained has been involved with thousands of these cases. He has given us examples of awards won by his law firm, but I want to know what the chances are of not winning.

Best Answer

Lawsuits like that take years to even get to court. The companies have big time lawyers, much more than the average person can afford. I see commercials on tv all the time about a class action lawsuit against the manufacturer, so that hasn’t even come to fruition yet. Like I said, years.

Can I ask what his lawyer has said? I’d think the lawyer would know, and also would know whether it’s best to file singly or as a class action.

And, of course, a lot depends on where your father-in-law was exposed to the asbestos and how long ago that was. Some of this can be difficult to prove, since it was very common at one time and he’d have to prove that whoever he’s suing is the source of the cancer. So I’d wonder why the manufacturer is being sued, rather than the place where he was exposed to it.

My best advice is to make sure he has a good attorney. Tort cases usually base fees on contingency, so he shouldn’t have to spend any of his own money, but for something this important make sure the attorney knows what he’s doing.

For some reason, their treatment (small injections you take several times a day containing immune system proteins) works especially well with mesothelioma, and they are well known for treating it, and often get referrels from Stateside and British MD.s.
Cancer is found in the acidic tissue, where dead cells do not necessarily die, but become abnormal and irregular. This promotes the chances of cancer cells becoming less dormant and becoming abnormal. The less of an acid producing body you have, the less chance of cancer forming. The same is thought if you already have cancer. kemo is not always enough, but consuming foods that leave your body with a more base pH, the better your chances of preventing your cancer from spreading to another area and growing. Also, habbits that get your body producing alkine, such as colder showers instead of warm ones. Anything that gets your nerves jolting will cause your body to raise its pH level.A long time ago, Dr. Otto Warburg won a nobel peace prize for proving that cancer is anaerobic; meaning they thrive only in a low-oxygen state. Alkaline tissue holds 20 times more oxygen than does acidic tissue.

Most the settlements are out of court and the amount of money is not disclosed. Most people are lucky to get enough money to cover their medical expenses and lost wages. It is unlikely that an individual would win a settlement of $84 million, but anything is possible with a jury. Most of the time when people win exorbitant settlements they usually have to spend the rest of their life trying to actually collect the money.

Hi,I do a lot of research into mesothelioma, and run a website that is dedicated to providing up to date information concerning asbestos and its harmful effects on health.

The largest percentage of mesothelioma patients have developed it as a result of being exposed asbestos over a long period of time. I.e. during their employment, or someone who has had to wash their spouses clothing over many years, unwittingly not realizing that the clothing is contaminated with asbestos fibers.

The majority of people that will be diagnosed with mesothelioma within the next 20 year period, are those who have been heavily exposed to asbestos – 20-40 years previously, prior to when asbestos was banned. Therefore after 2020, there will be fewer people diagnosed with the disease.

People who are still at risk from developing mesothelioma are those who are unwittingly are doing a job where asbestos still remains. I.e. In old buildings. For instance – the plumber may constantly work on asbestos covered pipes etc, and may cut into the asbestos or tear off the asbestos, releasing the deadly fibers into the air and inhaling them.

Asbestos is only dangerous when it is friable (crumbly) or when it is disturbed. I.e. cut, sawn, drilled or sanded, etc.

It would be highly unlikely that you could develop mesothelioma after a short exposure to asbestos, but cutting out the risk completely would be the best option to take.

I recently read a story about one man who developed mesothelioma as a result of scraping moss off his asbestos garage roof for many years. He did not realize that it was asbestos or that – every time he scrapped the roof – he released the fibers and inhaled them.

Thank you highlighting mesothelioma,

Kind regards,
